Introduction
Welcome to the Ouatcha Matcha Creator Program (the “program”)! This program is designed to reward approved creators and affiliates for referring new customers to Ouatcha Matcha. By applying to or participating in the program, you agree to be bound by these Terms and Conditions in their entirety.
Eligibility
- Applicants must be at least 18 years old and have a valid email address capable of receiving payouts through Tremendous, the payout platform used by Ouatcha Matcha.
- Ouatcha Matcha reserves the right to approve, reject, suspend, or remove any participant at its sole discretion, without obligation to provide a reason.
Enrollment and Participation
- Approved participants will receive, by email from collabs@ouatchamatcha.com, a unique discount code and a dedicated referral link. The referral link applies the discount code automatically. Each code gives the participant’s audience 15% off eligible orders.
- By joining the program, participants agree to receive program emails from Ouatcha Matcha, including onboarding and program updates, as well as Ouatcha Matcha marketing emails. Participants may unsubscribe from marketing emails at any time using the link in any email.
- Participants may promote Ouatcha Matcha only through lawful, honest, and brand-appropriate methods consistent with Ouatcha Matcha’s brand guidelines.
- Participants are responsible for ensuring that all promotional activities comply with applicable laws, regulations, platform rules, and disclosure requirements, including FTC endorsement guidelines.
Codes, Links, and Qualifying Sales
- Commissions are earned only on qualifying sales directly attributable to the participant’s unique discount code or referral link.
- A qualifying sale is a completed, paid order that has not been canceled, refunded, returned, charged back, or otherwise disqualified by Ouatcha Matcha.
- Commissions are not earned on self-referrals, purchases made by the participant, or purchases made by members of the same household, unless expressly approved in writing by Ouatcha Matcha.
- Ouatcha Matcha reserves the right to determine, in its sole discretion, whether a sale qualifies for commission.
Commissions and Payments
- The current commission rate is a 30% cash commission on eligible orders placed with the participant’s discount code or referral link, and the current audience discount is 15% off. Commission rates, discount terms, and payout structures are set by Ouatcha Matcha and are communicated to participants by email. Ouatcha Matcha reserves the right to update these at any time, with at least 7 days’ notice for any material changes to commission rates.
- Commissions are calculated monthly from the eligible orders placed with each participant’s discount code or referral link, and are paid through Tremendous to the email address on file.
- Commissions become payable only after payment has been successfully collected from the customer and the order has passed any applicable review, fraud-check, or return period.
- Any canceled, refunded, returned, fraudulent, or disputed order may result in the reversal or withholding of the related commission.
- Ouatcha Matcha reserves the right to review and verify all referred sales before approving commissions or payouts.
- Ouatcha Matcha may withhold or delay payouts while investigating suspected violations of these Terms and Conditions.
- Participants are responsible for all taxes, duties, and withholdings applicable to their commission payments. Ouatcha Matcha may collect tax identification information (including a completed W-9 for U.S.-based participants) as required by applicable law. Participants who meet the applicable IRS reporting threshold in a calendar year may receive a Form 1099-NEC. Failure to provide required tax information may result in delayed or withheld payments.
Prohibited Activities
Participants may not engage in any of the following:

If a participant becomes aware of unauthorized public distribution of their code, they must notify Ouatcha Matcha promptly. Ouatcha Matcha reserves the right to void commissions and terminate participation for any unauthorized code distribution.

Termination and Suspension
- Ouatcha Matcha may suspend or terminate a participant’s access to the program at any time, with or without notice, for any reason, including suspected violations of these Terms and Conditions.
- A participant may leave the program at any time by discontinuing participation and notifying Ouatcha Matcha by email at collabs@ouatchamatcha.com.
- Upon termination, the participant must immediately stop using all Ouatcha Matcha discount codes, referral links, and brand materials, and must remove any active affiliate content upon request.
- Any unpaid commissions will be forfeited if the participant is terminated for violating these Terms and Conditions. Commissions earned prior to any non-violating termination will be paid in accordance with the standard payout schedule.
Limitation of Liability
Ouatcha Matcha will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of revenue, profits, goodwill, use, or data arising out of or related to the program, even if Ouatcha Matcha has been advised of the possibility of such damages. Ouatcha Matcha’s total liability to any participant under this program shall not exceed the total commissions paid to that participant in the three months preceding the claim.

Any dispute arising out of or relating to these Terms and Conditions or the program shall be resolved exclusively in the state or federal courts located in Texas, and each party hereby consents to the personal jurisdiction of such courts.
